A STUDY ON PREDICTIVE JUSTICE POWERED BY AI
Asst. Prof. Aravind Nair
DOI : 10.5281/eiirj.15746083
Abstract
Certificate
There are numerous benefits to the advancement of predictive justice for the efficient functioning of the legal system. The application of predictive algorithmic models can improve legal certainty by incentivizing judges to base their decisions on earlier decisions. Apart from standardizing the way the law is applied, it can also assist stakeholders in making informed decisions before a court case, encourage timely case resolution, referrals for sentencing, out-of-court settlements, and prioritize cases where violations seem likely. The challenge is creating a system that maintains fair procedure while simultaneously addressing the concerns of those impacted by this automated justice system. This necessitates a strong policy that lays out the guidelines for predictive justice in court cases and puts the necessary protections in place. Judicial reforms that integrate the work of the central government through the Ministry of Law and Justice with the judiciary should enable predictive justice.

GREENWASHING: A CHALLENGE TO CORPORATE SOCIAL RESPONSIBILITY AND ENVIRONMENTAL LAW
Mrs. Glodit Raphel
DOI : 10.5281/eiirj.15746353
Abstract
Certificate
Environmental concerns have escalated due to the problem of green washing. Businesses are being compelled to take environmental problems seriously as consumers choose more environmentally friendly products and environmental issues become increasingly prominent.
This paper explores the growing issue of greenwashing, where corporations deceptively present themselves as environmentally responsible without implementing substantive sustainable practices. The paper examines the intersection of greenwashing with corporate social responsibility (CSR) and environmental law, analyzing the challenges it presents to both concepts. It presents a serious obstacle to Corporate Social Responsibility (CSR) since it calls into question the validity of sincere attempts by businesses to lessen their environmental effect. The efficacy and overall credibility of CSR activities may suffer if customers do not believe that businesses are open and truthful about their sustainable policies. It evaluates existing regulations aimed at curbing greenwashing and discusses how corporate governance, consumer protection, and sustainability law need to evolve to address the issue. The purpose of this study is to determine if green washing offers a glimpse into a real, environmentally friendly world or if it is merely a theoretical idea.

LICENSING AND FRANCHISING: MONETIZING INTELLECTUAL PROPERTY FOR BUSINESS GROWTH
Asst. Prof. Hanisha Bathija
DOI : 10.5281/eiirj.15746383
Abstract
Certificate
In the modern economy, Intellectual Property Rights (IPR) play a crucial role in business growth and revenue generation. Licensing and franchising are two key strategies that enable companies to monetize their intellectual property effectively. Licensing allows IP owners to grant rights to third parties for using their patents, trademarks, copyrights, or trade secrets in exchange for royalties or fees, ensuring a steady revenue stream while maintaining ownership. Franchising, on the other hand, expands business operations by allowing franchisees to use a proven business model, brand name, and proprietary knowledge under a structured agreement. This paper explores the advantages, challenges, and best practices associated with these strategies, highlighting how businesses can leverage IPR for long-term profitability and competitive advantage. Additionally, it examines case studies of successful licensing and franchising models across industries to provide insights into effective monetization approaches.

REVIEW OF INDIAN LABOR LAWS AND POLICIES IN THE ERA OF ARTIFICIAL INTELLIGENCE
Dr. Surabhi Gupta
DOI : 10.5281/eiirj.15746821
Abstract
Certificate
The integration of Artificial Intelligence in workplaces across various sectors will have profound effects on the labor and employment landscape. The implementation of AI technologies by companies could result in the replacement of human workers, raising issues regarding employers' responsibilities to notify in advance, act with caution, and offer alternative job opportunities. Even with the simultaneous presence of human and automated labor, significant transformations in the dynamics of employer-employee relationships are anticipated, along with changes to the structure of Trade Unions and the methods of collective negotiation. Worries regarding employee privacy and the use of AI systems for hiring or monitoring continue to be a controversial topic, and in the absence of proper regulations, could lead to unwarranted infringements on privacy. The consequences of artificial intelligence on labor and employment law are briefly covered in this research paper, which also suggests practical and tangible changes to facilitate a seamless transition to an AI-enabled workplace. In order to guarantee human control and supervision over the collective bargaining process, it suggests amending the definitions of employer and employee and adding a provision. Additionally, it suggests imposing a responsibility of restraint on the employer and introducing safeguards to protect workers from being arbitrarily fired for technological reasons. In line with recent advancements in other jurisdictions, it also suggests legislative changes to regulate the use of AI systems in hiring by employers.

ASSESSING THE EFFECTIVENESS OF INVESTOR PROTECTION LAWS AGAINST THE INFLUENCE OF FINFLUENCERS: A LEGAL ANALYSIS
Mrs. Usha Gupta
DOI : 10.5281/eiirj.15746872
Abstract
Certificate
Social media has significantly transformed the way information is shared and consumed, particularly among younger generations who turn to these platforms for solutions to various personal issues. Among the growing number of content creators are social media influencers in the financial sector, known as "finfluencers." These individuals, with substantial followings on platforms like YouTube and Instagram, offer investment advice, promote financial products, and sometimes provide specific investment recommendations. The rise of finfluencers has established a new dynamic between financial institutions and consumers, positioning them as intermediaries who provide accessible and engaging content on financial topics. For many investors, especially younger ones, social media has become the primary source of information about personal finance and investment strategies. While this has made financial education more widely available, it also raises concerns regarding the authenticity of the advice provided and the potential risks involved. Since the advice from finfluencers is often unregulated and their expertise varies, there is a significant risk of misleading novice investors. This research paper investigates the role of finfluencers in the investment decision-making process, with a focus on the adequacy of existing regulatory frameworks. Given the growing influence of finfluencers, there is a clear need for stricter regulations to protect retail investors from potentially harmful or unqualified financial advice.

Many cases have been addressed under this act but still the many cases have not been reported or many have not been resolved for years together. Also, another aspect to the law is the reports have come about women taking undue advantage of the provisions in the case and reporting cases against individuals with ‘malicious intentions’. This paper explores whether employees are aware about the act, provisions in the act as well as punishment against malicious or false complaints.

THE RISE OF "DARK PATTERNS" IN ONLINE ADVERTISING: THE AWARENESS GAP

Abstract

The digital marketplace has revolutionized consumer experiences, but with this transformation comes a hidden menace—"Dark Patterns." These deceptive design tactics in online advertising manipulate consumer behavior, making it difficult for users to make informed decisions. From misleading urgency countdowns and forced subscriptions to hidden fees and sneaky pre-checked boxes, dark patterns subtly push consumers into choices they might not otherwise make. While these tactics benefit businesses, they pose serious threats to consumer rights, financial security, and privacy. This research delves into the awareness levels of Indian consumers regarding dark patterns, their experiences with deceptive online advertising, and the legal and regulatory challenges in India.
To assess the real-world impact of dark patterns, a structured survey was conducted to collect first-hand insights from Indian consumers. The results reveal that a significant majority of users remain unaware of the existence of dark patterns, despite being subjected to them frequently. Many consumers unknowingly fall into traps, such as auto-renewing subscriptions, false scarcity messages, and disguised ads that appear as genuine content. The psychological impact of these manipulative tactics creates frustration, financial losses, and erodes trust in digital platforms. Interestingly, younger consumers, who are more tech-savvy, tend to be more aware of dark patterns but still struggle to avoid them due to the overwhelming nature of digital interfaces.
A deep dive into India’s legal and regulatory framework reveals that, while consumer protection laws exist, they do not explicitly address dark patterns in digital advertising. The Consumer Protection Act, 2019, the Information Technology Rules, 2021, and the Advertising Standards Council of India (ASCI) guidelines aim to curb unfair trade practices but lack direct provisions against manipulative UI designs. This regulatory blind spot allows businesses to exploit digital loopholes, making enforcement difficult. Moreover, the lack of awareness among consumers and limited legal precedents make it challenging to hold companies accountable for deceptive practices.
Given the growing dominance of digital commerce in India, there is an urgent need for regulatory intervention, stronger enforcement mechanisms, and consumer education initiatives. This study highlights the necessity of stringent legal reforms that clearly define and prohibit dark patterns, ensuring businesses adhere to ethical advertising standards. Additionally, empowering consumers with knowledge about deceptive tactics can equip them to make more informed choices, thereby reducing their susceptibility to manipulative strategies.
As online advertising continues to evolve, the battle between ethical commerce and deceptive manipulation intensifies. Addressing dark patterns is not just about regulating digital marketing; it is about restoring consumer trust, promoting fair trade practices, and safeguarding digital rights. This research aims to contribute to this mission by shedding light on deceptive advertising tactics, pushing for legal clarity, and advocating for a more transparent and consumer-friendly digital ecosystem in India.

E-commerce is a method of conducting business electronically rather than through traditional physical means. This includes all internet-based retail activities such as purchasing goods, receiving services, delivery, payment facilitation, and supply chain and service management. Get to know about the E-Commerce Laws and Regulations in India. Government initiatives such as Startup India, Digital India, the allocation of funds for the BharatNet Project, the promotion of a “cashless economy,” and the launch of the Unified Payment Interface by the RBI and the National Payment Corporation of India have all contributed to the country’s e- commerce sector’s growth and success. Hence, it is very important that this new platform known as e-commerce has to be governed and regulated by laws which will ensure that the consumer is protected while entering into e-commerce business.
